MDAC: Call for participation in legal training on the right of children with disabilities to be free from torture

Description:

The training aims to create a pool of lawyers in Central and Eastern Europe (CEE) who are familiar with torture, cruel and inhumane and degrading treatment and punishment (TCIDTP) of children with mental disabilities (CWMD) and possess the tools and knowledge to litigate this successfully.

Specific objectives:

  • Increase the knowledge of lawyers on the forms and prevalence of TCIDTP of CWMDs;

  • Provide skills necessary to work with child victims of TCIDTP who have a mental disability;

  • Examine the barriers child victims of TCIDTP with mental disabilities face in accessing justice and find solutions; and

  • Develop legal arguments and strategies to ground strategic litigation.

The training will take part in two sets:

  • 11-13 April 2017 (3 days). An initial 3-day course will examine international law standards on torture and the inter-relation with children’s rights (e.g. to participation) and disability rights (e.g. to rehabilitation and reasonable accommodation).

  • October 2017 (2 days, dates TBC). Lawyers will re-convene for an advanced 2-day course focusing on the types of TCIDTP suffered by CWMD, the physical and psychological effects and the types of remedies and rehabilitation which might be necessary. The training aims to result in the initiation of strategic cases on behalf of child victims of TCIDTP with mental disabilities.

Other relevant information: There is no fee for this training. Travel and accommodation costs will be covered by MDAC for successful application, with the kind support of the United Nations Voluntary Fund for Victims of Torture.

Eligible candidates:

  • Practicing lawyers in the following countries: Bulgaria, Czech Republic, Hungary, Montenegro, Republic of Moldova, Romania, Russia, Serbia, Slovenia.

  • Special interest (and relevant experience) in litigating cases of torture and cruel, inhuman and degrading treatment or punishment on behalf of children with mental disabilities.
